Terms and Conditions
I – Subject Matter and Scope
The following Terms and Conditions govern the contractual relationship between photographer Adrian Alexander (hereinafter “Photographer”) and his clients in connection with photographic and videographic services.
Services include the creation of high-quality photos and videos in accordance with the client’s specific requirements. The exact scope of services is defined within an individual quote or written agreement.
II – Scope of Services
The Photographer undertakes to carry out the agreed services with the utmost professionalism. All photos are edited to ensure optimal image quality. Basic editing including colour and contrast adjustments is included in the agreed price.
Extensive retouching will be invoiced separately. Video recordings are delivered in 4K at 25fps in the sRGB colour space as an MP4 file with H.265 codec, unless otherwise agreed.
Video footage is delivered exclusively in the recorded format and will not be cut or otherwise edited unless a separate agreement has been made. Film productions include 2 rounds of revisions.
III – Usage Rights
The copyright to all photos and videos remains with the Photographer. The client acquires the right to use the material for the agreed purposes. The Photographer reserves the right to use the created works for their own marketing purposes, unless exclusivity has been agreed.
When using the material, the client is obliged to credit the Photographer as the author. Any further editing is only permitted with prior agreement.
IV – Delivery of Photos and Videos
The delivery period begins on the last day of the shoot. The Photographer undertakes to complete delivery within 3 business days, unless otherwise agreed. Files are provided in digital form via download link.
The client agrees that the Photographer assumes no obligation to archive files after delivery. The client has no entitlement to RAW files.
V – Acceptance of Photos and Videos
Acceptance is deemed to have occurred if no justified objections are raised by the client within 7 days of the files being made available. Complaints do not entitle the client to withhold payment.
VI – Selection of Photos and Videos
The Photographer reserves the right to select the best shots according to their professional judgement. The client agrees that not all images taken during the assignment will necessarily be made available.
VII – Access and Photography Permits
The client ensures unobstructed access to the agreed shooting location. Obtaining any necessary photography permits is the client’s responsibility. Costs for admission tickets or permits are borne by the client.
Should the agreed appointment be unable to take place for reasons beyond the Photographer’s control, additional costs of €100.00 plus travel expenses may apply.
VIII – Artistic Freedom
The Photographer reserves the right to act freely in the artistic execution within the agreed conceptual framework. Any specific artistic requirements on the part of the client must be documented in writing in advance.
IX – Right of Withdrawal and Cancellation
The client has the right to withdraw from the contract within 14 days of conclusion without giving reasons. In the event of short-notice cancellation, a cancellation fee will apply.
X – Liability
The Photographer is liable for damages caused intentionally or through gross negligence in accordance with statutory provisions. Liability for loss of profit, indirect damages or consequential damages is excluded.
XI – Retention of Title and Payment Terms
Delivered photos and videos remain the property of the Photographer until full payment has been received. Payment is due within 14 days of receipt of invoice, unless otherwise agreed.
XII – Severability Clause
Should any individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall not be affected.
XIII – Applicable Law and Jurisdiction
The law of the Federal Republic of Germany applies. The exclusive place of jurisdiction is Munich.
